General Conditions

These general terms and conditions apply to all services performed by Hotel Ter Elst, unless explicitly deviated from in a specific and written agreement. By placing a reservation or requesting a quote from Hotel Ter Elst, the customer acknowledges having taken cognizance of these general terms and conditions and accepts its applicability without reservation, to the exclusion of his own general terms and conditions.

Prices and confirmations

Parties are bound by the prices as stated in the price quotation of Hotel Ter Elst.

Reservations must always be confirmed by Hotel Ter Elst. Returning a signed quote or confirmation is sufficient to confirm a reservation. Every document signed by the customer connects the signer in his own name as well as the person or legal person for whom the signer acts.

Hotel Ter Elst will always act to the best of its ability and always endeavor to perform the ordered performance in accordance with customer expectations.

Modification and / or cancellation of reservations unless otherwise agreed contractually

Parties must always adhere to agreed times and numbers.

Hotel Ter Elst reserves the right to request an advance on the quotes / reservations. If the advance is not paid by the Customer within the period set by Hotel Ter Elst, Hotel Ter Elst reserves the right to cancel the reservation with immediate effect and without prior notice.

Cancellations and / or changes must always be notified in writing. At Hotel Ter Elst this is done by fax on the number 03/4509090 or by mail on info@terelst.be. The customer can only rely on the cancellation if he received a notification of receipt from Hotel Ter Elst as proof of the cancellation requested.

Reservation of an event:

An event can always be canceled under the following conditions unless explicitly agreed otherwise in the agreement:

If an event is canceled more than 30 days in advance, this is free of charge.

If an event is canceled less than 30 days in advance, 50% of the total price offer will be charged and 100% of the room rental (in the case of a package, 100% of the official room rental will be charged), as well as those already charged by Hotel Ter Elst costs incurred.

If an event is canceled less than 10 days in advance, 100% of the total price offer will be charged as well as the costs already incurred by Hotel Ter Elst.

The number of people for an event can be changed up to one week in advance, and only in writing. In the event of a change less than one week before the event, the initial number of people will be billed as a minimum.

Reductions of a maximum of 25% compared to the stated number from the quotation / reservation will be accepted, so that at least 75% of the initial quotation / reservation will always be invoiced. Reductions of more than 75% compared to the number stated in the offer / reservation can be equated by Hotel Ter Elst with a cancellation, and the customer can be charged 100% of the total price quotation as well as the costs already incurred by Hotel Ter Elst.

Unless prior written agreement from Hotel Ter Elst, the number of participants can only be increased by a maximum of 10% of the initial number. Additional participants will be charged at the agreed rate.

If a change in the number of participants causes an extra cost for Hotel Ter Elst (eg other room, extra staff, etc.), this cost can be charged to the customer.

Reservation of a room

The reservation of a (meeting or party) room can be canceled free of charge up to 30 days in advance, and only in writing. For a later cancellation, 100% of the room rent will be charged (in the case of a package, the official room rent will be charged).

Reservation of hotel room(s)

Cancellation of hotel rooms is free of charge up to 30 days before the scheduled arrival date (before 12:00). unless otherwise agreed in the agreement. For cancellations after 14 days before arrival or in case of "no show" 100% of the room rate will be charged.

Payment

The events at Hotel Ter Elst are billed automatically the day of the event.

Hotel Ter Elst invoices its services the day after the activity. The invoices are sent by post or by e-mail. If the customer wishes to pay on the day of the performance, he must state this when booking. The bill is then presented to the hotel reception and the bill is sent later. If the customer wishes a PO number or other reference to be included on the invoice, the customer must provide this number / reference to Hotel Ter Elst before the start of the event.

Unless otherwise agreed, all invoices or invoices from Hotel Ter Elst are payable within 14 days after the invoice date. Failing to comply with this will, by operation of law and without prior notice of default, the invoice amount be increased by 10% (and with a minimum of € 125.00) and a default interest of 10% per year up to the day of full payment will be due. In addition, all costs (including legal costs) caused by the customer's default will be borne by the customer.

Complaints must be submitted in writing within 24 hours after the cause of the complaint arises. After this period, complaints are no longer valid and the performance of Hotel Ter Elst is considered to be definitively accepted. For the food and drinks supplied, no complaints are possible after consumption. Sending or issuing the VAT note to the customer does not contain any proof or suspicion that the bill was paid by the customer. Nor does it not sign the bill.

Hotel Ter Elst never pays commissions to intermediaries, unless explicit prior agreement has been made.

General

The customer is not permitted to use his own catering at Hotel Ter Elst unless explicitly agreed in writing. Where applicable a supplement will be charged.

Hotel Ter Elst processes your personal data for customer management and direct marketing. If you do not wish to receive messages about future promotions or promotions, you can object to this free of charge. Your data can be communicated to processors who work on our behalf. The Personal Data Processing Act gives you the right to view and correct your data. To exercise these rights, you can contact Hotel Ter Elst via info@terelst.be. A public register of automated processing of personal data is kept at the Commission for the protection of privacy (1000 BRUSSELS, Waterloolaan 115). If, due to unforeseen circumstances, some of the agreed food and beverages cannot be delivered, Ter Elst reserves the right to adjust the menu with equivalent food or beverages, without this leading to a reduction in price or compensation.

The customer expressly declares to renounce the shortened limitation periods provided for in art. 2271 of the Dutch Civil Code, insofar as this article applies to the services provided.

Damage caused intentionally or unintentionally to goods, installations or infrastructure of Hotel Ter Elst falls under the responsibility of the person who caused it and the person who reserved the event.

The client must comply with and is responsible for administrative obligations for the event that he organizes, such as requesting admission from the government, SABAM, fair compensation (only applicable for dance, excluding wedding party, etc.) . The customer shall fully indemnify Hotel Ter Elst against any claim that would be made against Hotel Ter Elst for non-compliance by the customer with any obligation.

Hotel Ter Elst cannot be held liable, except in the case of intent or gross negligence, for any loss or damage of any kind whatsoever that would be wholly or partly the result of a hotel Ter Elst or one of its employees attributable error or negligence in the performance of the services provided.

The liability of Hotel Ter Elst is in any case limited to the amount charged by Hotel Ter Elst / Kasteel Solhof for the part of the services to which the claimed liability relates.

In no event can Hotel Ter Elst be held liable for damage or theft of material from customers or third parties.

Without prejudice to the aforementioned provisions, Hotel Ter Elst has the right to suspend the performance of its services if one of its statements or invoices was not paid on time and this until full settlement of the outstanding amounts.

Hotel Ter Elst can terminate any agreement without notice or judicial intervention with immediate effect if the customer does not fulfill, properly or not fulfill one or more of his obligations towards Hotel Ter Elst, eight (8) calendar days after sending a registered notice of default. fully complies or acts contrary to it.

Hotel Ter Elst also has the right to terminate the agreement with immediate effect without notice of default or judicial intervention if the customer has been declared bankrupt, has suspended his payments, has requested deferment of payment or has been obtained from one or more of his creditors, or has lost control over its assets. The customer is then not entitled to compensation.

Every agreement entered into with Hotel Ter Elst is subject to Belgian law. All disputes fall under the exclusive jurisdiction of the peace court or the court that has jurisdiction in the district of the seat of Hotel Ter Elst.

The invalidity, invalidity, non-enforceability or non-enforceability of (a) provision (s) does not in any way result in the invalidity, invalidity or non-enforceability of the other provisions. All contracts with Hotel Ter Elst/Kasteel Solhof are subject to Belgian law. All disputes fall under the exclusive jurisdiction of the court or the peace court in the district where Hotel Ter Elst/Kasteel Solhof is located.
